Spaces may be subleased up to seven months between October 1 and April 30. Subleases are not allowed from May 1 through September 30.

The Subtenant is to be provided with water, basic cable TV, internet service, sewer, and garbage disposal. Other services internally or externally provided are, electrical power, gas/propane, and wireless internet access. Shareholder will provide subtenant information regarding these during rental agreement process. Subtenant is also responsible for any equipment required for wireless internet service (router). For more than basic cable TV and wireless internet service Subtenant needs to contact Spectrum 1-888-406-7063 to arrange. Subtenant is also responsible for rental of equipment (router) required for wireless internet service.

NOTE: Neither the Board of Directors, nor any Wintergardens employee is responsible for providing the subtenant with access to the rental property. It is the sole responsibility of the shareholder to provide access to keys for the unit.INDEMNIFICATION: To the fullest extent permitted by law, subtenant shall defend, indemnify, and hold harmless Wintergardens and its guests, agents and employees from and against all claims, damages, losses and expenses, including but not limited to attorney fees and costs arising out of, connected to, or resulting from, pursuant to this Agreement, regardless of whether or not any such claim, damage, loss or expense is caused in whole or in part by any negligent or intentional act or omission of the subtenant and regardless of whether or not it is caused in part by a party indemnified hereunder.GOVERNING LAW: This Agreement shall be governed, construed, and interpreted by, through and under the Laws of the State of Arizona.CONSTRUCTION: The words "shareholder" and "subtenant" as used herein include the plural as well as the singular. The pronouns used herein shall include, where appropriate, either gender or both, singular and plural.RECEIPT OF DOCUMENTS: Subtenant(s) is bound by, and agrees to abide by the Rules and Regulations of Wintergardens and any changes thereto, with or without notice.If the Owner at any time sublets the Unit and defaults in the payment of any assessment, Wintergardens may, at itsoption, so long as the default continues, demand and receive from the subtenant assessments due or becoming due fromeach subtenant to the Owner and apply such assessment to pay sums due and to become due from the Owner toWintergardens. Any payment by the subtenant to Wintergardens shall constitute a discharge of the obligation of suchsubtenant to Owner to the extent of the amount so paid. BOARD OF DIRECTOR APROVAL: This sublease is not binding upon either party unless approved by the Board of Directors.

Fee Information

There is a twenty-five dollar ($25) administration fee per Shareholder Unit sub-lease, payable to Wintergardens. If the administration fee is not paid within thirty (30) days of the start of the sub-lease, the fee will be added to the shareholder’s assessment fee and therefore be subject to interest charges.

Shareholder Unit Sub-Lease forms can be submitted in person, by email or by fax to the office. There is a twenty-five dollar ($25) late fee for sub-lease forms not received by the office before the end of the last business day, PRIOR to the start of the sub-lease. This fee will also be charged for sub-lease forms not FULLY completed prior to the start of the sub-lease. If the late fee is not paid within thirty (30) days of the start of the sub-lease, the fee will be added to the shareholder’s assessment fee and therefore be subject to interest charges.
